Introduction

The policies below describe SageSure Insurance Managers LLC’s and its affiliates’ (collectively “SageSure”, “us,” “our”, or “we”) agreement with you (“you”) when you visit our public-facing website hosted under the domain https://sagesure.com (the “Site”), except as noted below. By using the Site, you signify your agreement to these policies. If you do not agree to these policies, you may not use the Site.

Please note that this Privacy Policy does not apply to your use of any SageSure account service available through the Site, such as the SageSure consumer account portal or the SageSure account payment processing applications. These services and functions are subject to their own terms of use and privacy policy which are available by accessing your SageSure account pages and portal login screens.

We respect your privacy and created this Privacy Policy to let you know what information we collect when you access and/or use our Site and how we may use or disclose it.

This Privacy Policy applies to visitors, users, customers, consumers, and others (“consumers” or “you”). It explains how we collect, use, protect, and share your personal information and your rights under the privacy laws of your state, and other applicable privacy laws and regulations.

By using this Site and providing your personal information to us through the Site, you consent to the use of the information that you provide to us in accordance with this Privacy Policy. We do update this Privacy Policy from time to time so please review this Privacy Policy regularly. If we materially alter our Privacy Policy, we will let you know of such changes by posting a notice on our Site and/or contacting you at the e-mail address provided to us. Your continued use of the Site will be considered your agreement that your information may be used in accordance with the updated Privacy Policy. If you do not agree with the changes, then you should stop using the Site.

 

Categories of Personal Information We Collect

We may collect the following categories of personal information from or about you:

  • Identifiers and personal information categories (e.g., name, date of birth, mailing address, phone number, email address, internet protocol address, Social Security number, insurance policy number, driver’s license number, bank account number and other payment information, financial history, marital status)
  • Protected classification characteristics (e.g., age and marital status)
  • Commercial information (e.g., records of personal property, payment history, claims history, other payment or financial information, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies)
  • Internet or other electronic network activity information regarding your interaction with our Site (e.g., browsing history, cookies, search history, information on a consumer’s interaction with the Site, application, or advertisement)
  • We collect the following information, which is considered to be “sensitive” personal information: social security number, driver’s license number, bank account number(s), and marital status.
  • We may collect details of your visits to the Site and the resources that you access, including, but not limited to, traffic data, location data, weblogs, and other communication data, including your IP address, timing, and content of what you viewed. Some parts of the Site use cookies and other tracking technologies to collect this information about your general internet usage and, if applicable, provide you with targeted advertising.   • When you use the search bar on our Site, we may collect information related to your search queries, including the terms you enter and your interactions with search results. This information may be used to improve our Site, analyze trends, and enhance your experience. We may also share search-related information with third-party service providers who assist us in processing and analyzing search queries or in delivering relevant content or advertisements. These third parties are required to handle your information in accordance with applicable privacy laws and our instructions. By submitting a telephone number or other contact information to SageSure, you agree that SageSure, and/or a representative acting on its behalf, can contact you at the telephone number you provide, potentially using automated technology (including texts/SMS messaging) or a pre-recorded message. Your consent is not an obligation to receive our products and/or services.

 

Sources of Information

We obtain the categories of personal information listed above from the following categories of sources:

  • Directly from our consumers. For example, we collect the information that you provide (or someone else who provides it on your behalf) when you fill out online applications, or other forms, and when you submit questions or comments online or by email or by text messages.
  • Directly and indirectly from activity on our Site. For example, we collect information from submissions through our website portal and website usage details collected automatically through cookies and other similar tracking technologies.
  • From consumer reporting agencies, public records and data collection agencies. For example, we collect information regarding your obligations with others, your creditworthiness, loss history, and claims data from these sources.
  • From transactions with SageSure or other nonaffiliated parties. For example, we collect information, such as your name, address, availability of funds, insurance coverage, transaction history, claims history and premiums, from these sources.

We collect information in the following ways:

  • Automatic Collection: If you download material or browse through the Site, our servers automatically collect certain information about you which may include: (a) the name of the domain and host from which you access the Internet; (b) the browser software you use and your operating system; (c) the Internet address of the Site from which you linked to the Site; (d) the Internet address of the device you used to access the Site and the location from which such access occurred; and (e) the time(s) when you accessed the Site.
  • Voluntary Collection: You may voluntarily enter or otherwise provide information to us on the Site, such as through a contact request form or email. You may also voluntarily provide information to us when you use certain features of the Site, such as applying for a job with us.

Purposes and Use of Collected Personal Information

We may use or disclose the personal information, including certain sensitive personal information, to the extent permitted, we collect for one or more of the following business purposes:

  • To fulfill or meet the reason for which the information is provided.
  • To provide you with information, products or services that you request from us.
  • To maintain or service consumer accounts and to provide customer service.
  • To provide you with email alerts, text message alerts, event registrations and other notices concerning our products or services, or events or news, that may be of interest to you.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Sharing and Disclosure of Personal Information

We may disclose your personal information, including certain sensitive personal information, to the extent permitted, to a third party for business purposes, as described above. As permitted by applicable law, we may share the following categories of personal information with a third party for a business purpose:

We may, as allowed by law, disclose your personal information, including certain sensitive personal information, for a business purpose to the following categories of third parties:

  • Third parties that use your personal information to process payments, validate your credit and loss history, and provide other similar services on our behalf.
  • Other insurance institutions, financial institutions, reinsurers, insurance producers, or consumer reporting agencies as needed in connection with any insurance application, policy or claim involving you.
  • Third parties that conduct research, including actuarial or underwriting studies.
  • Adjusters, appraisers, auditors, investigators and attorneys.
  • Third parties that may explore certain transactions with SageSure, such as certain investments, loan transactions, and mergers and acquisitions of portions or all of our business.
  • Third parties who perform business, professional or insurance functions for SageSure, including service providers, agents or independent contractors.
  • To our subsidiaries and affiliated companies.
  • We may disclose your personal information to law enforcement, government agencies, and other related third parties, in order to comply with the law, enforce our policies, or protect our or others’ rights, property, or safety.

Where we disclose personal information for a purpose set forth herein, we may enter into a contract with the third party that describes the purpose and requires the third-party recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

Third-Party Links

Our Site contains links to other third-party sites. If you use these links, you leave the SageSure Site and SageSure is not responsible for the privacy practices or content of such other sites. These external links are provided for your information and convenience only and are not an endorsement. SageSure makes no warranties or representations, express or implied, about such third-party vendors or the performance, reliability, or suitability of any referenced third-party product or service. Use of any third-party resources is at your own discretion and risk. SageSure disclaims liability for any damage or loss of any kind incurred in connection with the use of or reliance on any information, material, products or services contained on or accessed through any such linked website. We do not accept any responsibility or liability for their policies whatsoever as we have no control over them. How We Use Cookies and Other Tracking Technologies. Cookies are small text files placed on your device when you visit our Site. Our Site uses cookies and other tracking technologies to enhance your experience, analyze the Site’s functionality and performance, and provide personalized advertising related to your interests, such as recommendations and special offers. By continuing to browse the Site, you are agreeing to our use of cookies and other tracking technologies, which may include data exchange and/or disclosure with third parties.
We use the following types of cookies and trackers:

Third Party Website Service Providers. The Site works with third-party products and/or services (“Service Providers”) to offer and present our Site to you. These Service Providers may include, but are not limited to, Google, Qualtrics and LinkedIn, and other Service Providers who help us track and analyze our Site user activity, measure the effectiveness of our advertising efforts, and support the optimization of our digital marketing campaigns and carry out targeted advertising campaigns.

Our Service Providers may get more information about your activity on our Site, including pages you visit, access times, visit duration, how you arrived at our Site and your IP address. An IP address is a number that identifies a device connected to the internet. For most devices, the IP address changes on at least a weekly basis. Our Service Providers may also get device identifiers and specific information about the browser you use. In some cases, this information may be unique to you. We may share and/or sell your information collected from you on the Site with third party vendors, advertising companies, or analytics providers including, but not limited to, Google, Qualtrics and LinkedIn. The Site also participates in targeted advertising wherein it contracts with Service Providers to collect certain information when you visit the Site to provide measurement services to the Site and target ads to Site users, such as Google Ads and LinkedIn Ads. These companies use information collected from the Site (e.g., click stream information, browser type, time and date, subject of advertisements clicked or scrolled over, hardware or software information, cookie and session ID) and personal information (e.g., IP address) during your visits to this Site and other websites in order to tailor advertisements about goods and services to you. These Service Providers typically use a cookie, third party web beacon, or other similar tracking technologies to collect this information. The Site also works with third parties that collect information across various channels including, but not limited to, computers, mobile devices, and other connected devices, over time, for advertising, analytics, attribution, and reporting purposes. How do you change your cookie settings?

Opt-Out Signals

We will comply with opt out preference signals (OOPS) that inform us that you don’t want your personal information to be sold or used for targeted advertising, if the signal is sent from a platform or mechanism, such as Global Privacy Control, that enables us to accurately determine whether you are a resident of a state with an applicable privacy law regarding OOPS.

If your OOPS conflicts with your previously given privacy choice or your voluntary participation in any of our loyalty rewards or discount programs, as applicable, we will still comply with the opt out preference signal. We may notify you of the conflicting signals and ask you to confirm your choice with the understanding that it will affect your previously given privacy choice or participation in our loyalty rewards or discount programs.

How SageSure Responds to Do-Not-Track Signals

Certain state law requires commercial website owners and operators to disclose how their website responds to web browser “do not track” signals. If you have enabled your browser for that purpose, at this time, we do not honor “do not track” requests or change our services or information practices in any way as a result of receiving “do not track” requests from your browser.

Users’ Age

Our Site is designed and intended only for those who have reached the legal age of majority (18 years of age). By using this Site, you affirm that you are at least 18 years of age or older. We are not liable for any damages that may result from any user’s misrepresentations of age. SAGESURE DOES NOT KNOWINGLY COLLECT PERSONAL INFORMATION FROM CHILDREN UNDER THE AGE OF 13 AND CHILDREN UNDER THE AGE OF 13 ARE SPECIFICALLY PROHIBITED FROM SUBMITTING ANY PERSONAL INFORMATION ON THE SITE. IF YOU ARE UNDER THE AGE OF 13, DO NOT SEND SAGESURE ANY PERSONAL INFORMATION INCLUDING WITHOUT LIMITATION YOUR EMAIL ADDRESS, NAME AND/OR CONTACT INFORMATION. Under no circumstances may anyone under age 13 use the Site. Parents or legal guardians of children under 13 cannot agree to these terms on their behalf.

Consumer Privacy Rights under U.S. State-Specific Laws

If you are a resident of certain states, you may have the following rights under applicable consumer privacy rights laws, including, but not limited to, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, and/or any other applicable state consumer privacy rights laws promulgated or amended from time to time.   • Right to Access: You have the right to access the personal information we have about you, including the right to download or transfer your information, or to request a copy of your data in an electronic and portable format.
  • Right to Correction: You have the right to request correction of any inaccurate personal information.
    Right to Limit the Use of Your Sensitive Information: You have the right to ask that we limit our use of your sensitive information.
  • Right to Request Deletion: You have the right to request that we delete your personal information that we have collected about you, subject to certain exceptions.
  • Right to Appeal: You have the right to appeal any decision regarding your privacy requests.

Right to Non-Discrimination/Non-Retaliation: We will not discriminate or retaliate against you because you exercise your rights. For example, we will not deny you goods or services or charge you a different price or rate for goods or services if you make an access or deletion request.

Exercising Your Rights

To exercise the rights described above, please submit your request to us by either:

For all written requests, it is helpful to put the statement “Consumer Privacy Rights” in the body of your request, describe the nature of your request, and supply your name, street address, city, state, and zip code. In your request, you need to attest to the fact that you are a resident in the state in which you provided an address and provide a current address for our response. Once we receive your request, we will verify it by asking you to provide certain information, such as information regarding a recent purchase. We will honor requests received to the extent required by applicable law and within the time provided by the applicable law. If you would like to use an authorized agent registered with the Secretary of State to exercise your rights, we may request evidence that you have provided such agent with power of attorney or that the agent otherwise has valid written authority to submit requests on your behalf.

To appeal a decision made by us related to your rights, please email us at CustomerCare@sagesure.com with the subject line “Privacy Inquiry” and a detailed explanation as to why you are appealing our decision. Once received, a representative will review the request and respond to you within 30 calendar days.
We will not discriminate or retaliate against you if you exercise your rights under applicable law(s) related to your personal information that produce legal or similarly significant effects. Specifically, unless allowed by applicable law, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Generally, we will provide a response to a verifiable consumer request within forty-five (45) days of its receipt (or other time period as required by applicable law). If we require more time (up to an additional 45 days, or other time period as set forth in applicable law), we will inform you of the reason and extension period in writing. Any disclosures we provide will only include information that exists within our current records. The response we provide will also explain the reason(s) we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. California Shine the Light Law

Security

SageSure implements reasonable security measures to secure your personal information. Please understand, however, that no data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, SageSure cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to us is done at your own risk. If we learn of a security system breach we may attempt to notify you so that you can take appropriate protective steps. By using the services or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the services. We may post a notice via our Site if a security breach occurs. We may also send an email to you at the email address you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

Data Retention

We will not retain your personal information any longer than necessary to fulfill the purposes described in this Privacy Policy. Under our record retention program, we may be required to destroy personal information after we no longer need it according to specific retention periods. However, we may need to hold personal information beyond these retention periods due to regulatory requirements or in response to a regulatory audit, investigation, or other legal matter.
